Suspect in Jail Tonight Held on No Bond After Beating up Drive-Thru Store Clerk in Cowardly Attack

THE BREVARD COUNTY JAIL, FL  -- 

A Melbourne man is sitting in jail tonight after a ruthless and apparent cowardly and racist attack on a store clerk employee.

The attack took place during the evening hours at The Farmstores Drive-Thru store on Sarno Road in Melbourne. Police say a black male walked up to the white store clerk, and without saying anything, punched the clerk in the face for no reason. The suspect ran away westbound on Sarno Road, leaving the victim to bleed out. 

Melbourne Police Officer William Gould located the suspect, who was identified as 29-year-old Justin Timothy Terell Scott behind the HIWAYZE Smoke Shop near WalMart on Wickham Road a short distance away.  Scott was arrested for Felony battery. 

Records show Scott has a long history of violence, including 5 prior guilty convictions for battery and battery on a healthcare provider after being Baker Acted in 2023. He was also charged and found guilty previously of aggravated assault with a deadly weapon, breach of peace and trespassing.  He served 13 months locked inside the Florida State Prison for those offenses.

Scott previously had an address on Fee Ave but is now listed as "homeless." Scott was serving probation at the time of this incident. 

Judge Thomas J Brown ruled Scott as a danger to society and ordered Scott to be jailed indefinitely without bail at the Brevard County Jail where his next court appearance will be in front of Judge Michelle Baker On Jan 30th at 8am in Viera. A violation of probation hearing is scheduled for next month. 

The victim received stitches and was released from the hospital. We checked in with him and he is doing okay and intends to follow through with charges.
