A man is spending the night behind bars tonight after police and the fire department were called out to a possible fire on the barrier island at around 11am on Aug 15.

When first responders arrived, they entered the Ocean Front Wildlife and Habitat Preservation Tract noticed smoke and a gentleman lighting a fire with trash in a pile.

Satellite Beach Police Officer Emma Graham responded to the scene and identified 42-year-old Joshua Silber, listed as homeless, through previous encounters.

"The Smell of Urine and Feces"

The police officer immediately noticed the distinct odor of urine and feces in the area as Silber was sitting near a big tent.  There was also reportedly a large amount of trash throughout the protected preserve land, police say.

The police put the man under arrest and was brought to the Satellite Beach Police Station to spend the day.

Police were able to weight the trash on a large scale -- the weight of the collected litter was 128 pounds, reports say.

Silber was charged with illegal dumping of raw human waste and littering over 15 Pounds. He was eventually transferred over to the jail van later that evening and transported to jail to see a judge the next day.

The police department also requested restitution for cost of investigation in the amount of $174.60

First Court Appearance

At first court appearance in Sharpes, Judge David Koenig ruled there was no probable cause found in the dumping of raw human toxic waste.

He upheld the littering charge and held Mr. Silber in jail on a $250 bond. His next court date is September 3rd in Viera.
