THE BREVARD COUNTY JAIL, FL  -- 

The Blake Moia Show obtained a file dump of the arrests that took place on New Years Eve. Today, we are reporting on the dangerous folks who put others' lives at risk by deciding to drive a vehicle -- a potentially deadly weapon -- while under the influence of alcohol. There's a zero-tolerance policy for DUI here in Brevard County as there are simply other options to consider before getting behind the wheel while impaired. 

In total, there were nine DUI related arrests, and 1 dangerous high-speed pursuit in our area during the overnight NYE festivities. 

The suspects are technically considered "innocent until proven guilty" once tried in a court of law.

STEPHEN MARK HALL --

The Brevard County Sheriff's Office arrested 72-year-old Stephen Mark Hall after they received a call for service regarding an elderly male who was passed out in his truck behind the wheel in the parking lot at 220 A1A in Satellite Beach. 

The arrest report says the truck was displaying "Trump" stickers all over the truck, as described by the 911 caller. 

When deputies arrived and made contact with Hall, they reported that he was slow to get out of his truck, held on to the door for balance and staggered his way to the front of the deputy's patrol car.

Standard field sobriety tests were performed, and Hall failed every test. Hall also missed every single step performed in the straight-line walk. 

Hall was arrested and transported for booking, where he blew a .109 and a .104 on the breathalyzer.  He bonded out of jail prior to first appearance.

TRAVIS BURROUGHS --

Palm Bay Police responded to a call of criminal mischief in the area of Thor Ave in Palm Bay. The victim reported their tire was slashed out and the suspect fled the area in a grey Honda Civic. After the victim told officers that he would like to pursue charges, officers began to canvass the area and ultimately located the grey Honda Civic on Port Malabar Road and Babcock Road which was driven by 21-year-old Travis Burroughs.

Officials say the vehicle refused to stop for lights and siren and was "slow rolling" southbound on Babcock Street. The vehicle finally came to a stop a mile and a half away.

Officers smelled alcoholic beverage coming from the suspect's breath which ultimately led to the administration of standard field sobriety tests.

Burroughs failed the field sobriety tests and was placed under arrest. He blew a .227. 

In first appearance court, he waived legal counsel and declined to have an attorney represent him. His bond was set at $1,500.

RICHARD GUTIERREZ --

The Brevard County Sheriff's Office 911 center received a 911 call regarding a blue Mercedes that was swerving along Wickham Road in Melbourne. The caller advised that the driver, identified as 68-year-old Richard Gutierrez almost side swiped her vehicle and almost caused a collision.

Deputies were able to locate the blue Mercedes. Guttierrez told deputies that he had 4 drinks at Tracy's lounge. Deputies say he failed to maintain his balance, has slurred speech and swayed from side to side. Deputies say he failed the standardized field sobriety tests and was placed under arrest for DUI. He also refused breathalyzer testing.

Records show that Gutierrez has several prior convictions for DUI from 2002 and 2005. 

MICHAEL KIETH REYNOLDS --

Cocoa Beach Police say they spotted a black vehicle driving without headlights at 9:30pm. Officers conducted a traffic stop and observed glassy eyes, slurred speech and an "impurity" smell of alcoholic beverage coming from the breath of 44-year-old Michael Reynolds. Officers say the smell grew strong each time he spoke. 

Arresting officers noted there was an unopened case of beer in the passenger seat. When asked by the officers where he's going to, Reynolds replied, "home." When ask where Reynolds was coming from, he replied "home", and refused to perform any field sobriety tests. He was also given the opportunity to provide a breath sample at the scene at which he refused.

Reynolds was placed under arrest based on the circumstances and the observations of the officer.

In court, Reynolds was given a Pre-Trial Release bond and was ordered to submit to randomized drug and alcohol testing. His license is also suspended.  He will be on release but supervised by community control. 

DAVID WAYNE DORSCH --

Palm Bay Police charged 62-year-old David Dorsch after they say he failed to stop at a red light in his black GMC truck. The arrest took place at the intersection of Malabar and Minton Road. When officers made contact, they noticed slow and slurred speech, and bloodshot eyes.

Dorsch failed the standard sobriety testing and was placed under arrest. He refused to provide a breathalyzer sample. According to records, this will be his 4th DUI. There's also an active out of state fugitive warrant out for his arrest. 

His bond was set at $20,000 and is being held at the Brevard County Jail.

KALEB DAWSEY --

The Brevard County Sheriff's Office arrested 28-year-old Kaleb Dawsey, from Orlando, Florida, after he was stopped for speeding 60 miles per hour in a 45mph zone along S.R. 528. 

During the traffic stop, Deputies noticed a strong odor of alcohol from the breath of the driver, bloodshot eyes and slurred speech.  Deputies performed a field sobriety test, at which Dawsey demonstrated 6 clues during the eye roll test. 

During the heel-to-toe walk, Daw missed multiple steps and subsequently the turn around steps while using his arms for balance. 

Deputies determined that Dawsey was unable to operate a motor vehicle on public roadways safely and was placed under arrest. When arresting Deputies tried to place the suspect into the patrol vehicle, he resisted and was tackled to the ground.  Deputies were able to transport Dawsey to The Brevard County Jail. 
 
Authorities say Dawsey has also did not have an official vehicle registration for more than 3 years. He was issued a traffic citation for speeding and no vehicle registration.

He bonded out of jail prior to first appearance court.

JUAN LUIS FIOL --
 

The Melbourne Police Department arrested 78-year-old Juan Fiol after he fled the scene of a crash along Pennington Pl. and Wickham Road. Witnesses say a red truck that Fiol was driving failed to yield to on-coming traffic along Wickham Road and crashed into a victim.  The red truck fled the scene. Witnesses were able to locate a vehicle matching the description after driving through a nearby neighborhood and locating the truck matching the description which had substantial damage consisting of the crash.

When officers arrived, they located Fiol, who was passed out in the driver's seat with his seat belt on and the keys in his hand.  Officers knocked on the window to wake him and opened the door where they could smell a strong odor of alcohol on his breath.

Officers say Fiol had bloodshot eyes and slurred speech and wasn't able to stand.

Fiol told arresting officers that had only had 2, 4-ounce glasses of wine at "Beachside Wines" in Satellite Beach.  He failed the field sobriety tests.  The victim was taken to the hospital for injuries sustained during the crash.

Fiol was charged and booked for leaving the scene of an accident with injury, DUI, DUI with property damage, and issued 6 criminal traffic citations.  He provided the police with a breathalyzer sample which measured .085.

Bond was set at $5,000. He was appointed the public defender to represent him. 

JESSICA HELENE HAWK --

38-Year-old Jessica Hawk was arrested and charged after Brevard County Deputies performed a "well-being" traffic stop on a vehicle that was swerving all over the roadway along U.S.1 near Eau Gallie Blvd.  Hawk denied there was a medical episode or car mechanical problems, according to the arrest report

Deputies report the smell of alcohol coming from her breath, bloodshot eyes and slow dexterity. 

Hawk did not complete the field sobriety tests to standard and was arrested and charged with DUI.  She provided a breath sample which measured .206 and .212. 

Hawk was placed on Pre-Trial Release.

CARLOS BATISTA --

Palm Bay Police performed a traffic stop on 28-year-old- Carlos Batista after he was seeing driving through a parking lot in order to avoid a traffic control device, in violation of state traffic laws. Police say they observed Batista drifting from lane to lane.

The arrest report says Batista was making wide and slow turns and contacting the center fog line divider. Police performed a field sobriety test, who ultimately failed, and Batista was placed under arrest.  He refused to provide a breath sample to authorities. 

Through a Portuguese translator, a court appointed public defender is representing Batista. His bond was set at $500.
